These Terms and Conditions of Use (“Terms of Use”) apply to the Accessories Spares Centre’s (“ASC”) website located at www.accessoriesspares.co.za (the “Website”).

By accessing and using the Website, the user agrees to these terms of use set out in this legal notice. Should the user not wish to be bound by these Terms of Use, the user may not access, display and/or otherwise use content obtained at the Website.

ASC reserves the right, at its sole discretion, to change, modify, add or remove any part of these Terms of Use at any time without prior notice. The user acknowledges and agrees that it is their responsibility to review the Terms of Use periodically. The user’s continued use of the Website signifies acceptance of the revised Terms of Use.

The Website contains material including, without limitation, trademarks, text, graphics, product images, photographs, publications, videos and audio content (collectively, the “Content”).

All right, title and interest in and to the Website and the Content, including all intellectual property rights subsisting therein, are and shall remain the exclusive property of ASC or its licensors. Such rights include, without limitation, trademarks, copyright, patents, designs, inventions, goodwill, trade names, trade dress, any proprietary know-how and trade secrets, whether registered or unregistered.

Except as expressly permitted in these Terms of Use, no part of the Website or the Content may be copied, reproduced, republished, mirrored, framed, downloaded, uploaded, posted, publicly displayed, encoded, translated, transmitted, adapted, reverse engineered, exploited or distributed in any manner or medium for commercial purposes, without the prior written consent of ASC. Any unauthorised use of the Website or the Content constitutes a material breach of these Terms of Use and may result in the immediate suspension or termination of access and appropriate legal action, including proceedings based on infringement or unlawful competition.

Content that is expressly made available for download (including, without limitation, monthly buyer’s guides, catalogues and similar materials) or otherwise may be accessed and used solely for personal, non-commercial and informational purposes, strictly subject to the following conditions:

• all proprietary notices, including without limitation ASC watermarks, copyright notices and trademark designations, must be retained and clearly visible on every copy;
• the Content may not be altered, modified, adapted, translated, or used to create derivative works;
• the Content may not be distributed, sublicensed, sold or otherwise made available to any third party; and
• no representations, warranties or assurances may be given in respect of the Content without ASC’s prior written consent.

All rights not expressly granted are strictly reserved. Nothing in these Terms of Use shall be construed as conferring any licence or right, whether expressly, by implication or otherwise, to use any of ASC’s Website and the Content.
